A North Carolina town known for its annual “Possum Drop” on New Year’s Eve won’t be using a live opossum this year, Asheville Citizen-Times reports.

Brasstown has hosted the traditional event for 21 years in celebration of the new year. As the Times Square crystal ball is dropped, so is an opossum in a glass box slowly lowered.

However, due to a lawsuit from People for the Ethical Treatment for Animals (PETA). The case will likely go to court in 2015. If the judge rules in favor of Clay Logan organizer of the event, a live opossum will be used again in the future.

This year, the drop may feature a roadkill possum, or possibly even possum stew.
